On our way back home to Phoenix arizona from Winslow. We hit a snow storm 20 miles past Flagstaff. my brother was the driver and i the passenger. we tried to aviod a collision and went into the right lane which had another collision. we ended up in the median after avoiding the accidents and flipped his car. My brother was ok . I cut open my head and fractured my t12 vertabrae. I had to be extracted from the vehicle and rushed to Flagstaff Medical Center. my brother carries Progessive Auto, and was told I was covered up to $ 50000 So far the bills are around $ 53000 not including doctors fees and the ambulance ride which was 20 miles. I have no reason to sue my brother because thats wrong. but want to know if there are any options I might have overlooked. I spoke with a attorney and was advised I could get the $ 50000 and negotiate with ahcccs. and try to settle a price with them. and get something out of it. but dont know how that works. looking for any kind of advice.

It sounds like you are an honest person and don’t want to take advantage of the situation. However, a lawyer may be exactly who you want right now. If the PIP on your brother’s insurance ran out, the lawyer will fight for you to have all your medical care paid for. Progressive has their lawyers, you need one, too. Your brother won’t be the one that has to pay, the insurance company does. Most states it is illegal to raise rates after accident. Who was at fault? If it was another vehicle at fault partially or wholly, their insurance may get involved and have to pay.
You need to look out for yourself, you only have one body in this life and your injury sounds serious. Are you still going to need care? Have you stopped going to the doctor or physical therapists because of money? Do you have personal insurance? If they’re paying because of the accident, when and if they find out, they’ll want payment. The lawyer was saying you’ll get something out of it which is usually medical stuff covered plus pain and suffering. I know that phrase is annoying, but you missed work, couldn’t do things you used to, etc. that’s what he specializes in. He’ll charge 1/3 of your settlement but will put your mind at ease. Just meet with one and talk about your options. It’s nice to throw all your worries on your lawyer and have him take care of it because he’s getting paid well for it.
Check my advice out before you act on it, I’m not a lawyer and laws may be different in your state. Lawyers will fall over each other to take your case id they can make some $ $ .

I have already sent all of my information, medical and loss wages, to the adjuster. Are there any specific questions I should be asking or any information I should be aware of to know what is fair to settle. How much should I ask for when negotiating. My doctor bills are $ 6,000 and I had to make arrangements for my 4 children to be taken care of while undergoing treatment 4 times a week, one of which is a baby an one is special needs. I wasnt able to even clean my house due to back pain from the wreck. I just want to know what is fair compensation. Please help me so I know what to do when they call with an offer.

The main thing you need to find out is , is your back healed or could there be further medical care needed down the road???…sometimes claims are settled but with open medicals for 1 yr or more.

Question by Darcy: How much is my personal injury claim worth?
I’d like to start off by saying I really don’t want to be seen as greedy! I feel horrible for asking what dollar figure I’m entitled to, but I guess I really ought to get some information.
I got into a car accident last month, it was icy and my boyfriend’s truck slid into a pretty big ditch and we rolled. He was driving, he was not injured.
The insurance company has offered me $ 1000 dollars pain and suffrage, lost wages, and all medical.
My medical bills are probably somewhere in the 5-10 thousand dollars, (Just a guess, I haven’t received any bills)
I hurt like crazy! I can’t sit, stand or lay down (or sleep for that matter) without being in a lot of pain. I’m constantly drugged up, it takes the edge off, but it still is extremely uncomfortable. I hate being stoned all the time and being so goofy.
Any information would be extremely helpful, and if any further information is needed I’ll update! Thanks so much in advance.

A good rule of thumb is to ask for the following:
1. Lost wages
2. Medical expenses
3. Property damages
4. Pain & suffering equal to the medical expenses.

A few days ago, I went to the ER with the worst headache of my life. The doctor gave me 10 mg of Haldol im. I went home and at first didn’t even notice the shaking that I was doing. The next day I was severely restless, shaking, blurry vision, and I had severe muscle stiffness on my left torso. I went to a MEC center and the doctor was stunned that they gave me Haldol for a headache. The next day, my regular doctor told me that Haldol is used to treat Schizophrenia and he told me that I could have been seriously injured by the drug.
I feel so mad by this. What was that doctor thinking?!? Do you think that I have a claim here? Let me know.

I was a passenger in a single car accident. There were three of us. Myself and the supposed driver were knocked out of conscience during the impact. The owner of the car walked away. The owner currently has a broad form of insurance on his license. The driver had no insurance. I am going to be receiving large medical bills as I was hauled away in an ambulance and put through cat scans and what not in the trauma center. One lawyer office said there is no hope for getting my medical expenses covered…… does anyone know if this is true? I am in Washington State.
I did the Greg Swapp “One Call That’s All”. They informed me that the owner’s broad form insurance covers him only as an individual and since the driver had no insurance that I have to eat it. I would think that I would be covered under the owners insurance yet these guys are telling me i am not….. is this true?

“Supposed driver”? Either he drove or he didn’t. Either way, the owner of the car “supposedly” allowed the guy to drive, so it’s his insurance that’s responsible for damages. IF they don’t find a loophole to weasel out of it (like the “one law office” appears to be thinking).

A woman drove her car into the back of mine the yesterday and admitted fault. The damage to my car seems minimal.
My neck aches a little but its not causing me any severe problems. I havent been to the doctors and i’ve come into work today, it just hurts a little when i turn my head quickly. Im anticipating the pain will be gone in a couple of days.
One one hand i dont want to claim (and dont really think i have grounds to be honest) cos theres loads of scroungers who claim and i dont want to be one of them but on the other hand i think if everyone else does it, why shouldnt i?

I think that any problem that gets resolved by reasoning that begins with this:
“i think if everyone else does it, why shouldnt i?”
always ends badly.
This kind of thinking is why people drink too much, say abusive things to others, heck, it can explain all kinds of “herd behavior” including widespread damage and destruction in the Chinese Cultural Revolution (1966-1976).
So, I would start by listing the pros and cons of filing a claim, and weigh them out. You could also ask the advice of a trusted friend or relative. You could go to a doctor and find out if any real damage was done to your neck, too.

Question by r8drn8shn: No attorney wants my personal injury case. What do I do?
I was punched right in the eye on June 23 09. I still have the pain as Im writing this. Opthamologist couldn’t find anything wrong. The police haven’t done anything. I know this guys name and where he was staying at one time and am thinking of getting back at him HARDCORE style and I mean bad blood like how he left me a scar. No attorney wants to takemy case because he is 19 and might not have anything to sue for. Im going to get him for sure in 2 months maybe the anniversary just to show the police what happens when your with paramedics and you get laughed at by them. Its payback time. Im not this type of person but Im going to do it I want to gain 20 pounds by this time. This guy had seconds thoughts walking very slowly staring at my muscles. Im thinking of pepperspraying him then tackling his small skinny ass to the ground and pounding his head till I knock him out. I want to give this guy permanent damage.

Question by Marc: suing a school for personal injury?
I’m 19 now but when i was in 7th grade a 35 pound speaker fell from 11ft in the air an landed on my head during class. No x-rays were ever taken. Through the next years i started developing back problems where it got so bad i saw a chiropractor and went to physical therapy. After completing the healing process they pain would just come back. This pain caused me to stop playing soccer and miss my senior year (in which we won state champ).Recently I went to a new chiropractor and they took x-rays. They found that my spinal cord in the neck and lower back is way out of line and i have already developed arthritis in my neck. Can I sue the school for all of the money for my doctor’s appointments and pain and suffering? if so, how much?

talk to a good lawyer since this happened a while ago. but you can sue the school for whatever you feel you deserve. one stupid mistake like not hanging a speaker correctly has now changed your life entirely. i say go for it.

Question by richhotelinv: Colorado Statute of Limitations- Personal Injury/Police Brutality?
In May of 06 I was beaten and possibly tazered by Fort Collins Police. The event itself created great pain and also loss of memory. I have recently pieced things together to find that I was sent to an emergency room locally …beaten and battered (with proof) and never received a legal violation from the incident. I am now looking into my legal options and found that Colo has a 2 year statute of limitations. Are there any exceptions to this rule as I can prove that I was in a very bad place emotionally (the reason I was beaten)…and the incedent lead to more stress issues which blocked out the event. The police shot and killed my son’s grandfather in Jan 06 and when I saw a police car drive by I mentioned that they killed my son’s grandpa and ended up in the emergency room. Again,…I never received any type of legal citation from the authorities. Am I out of luck legally? Thank you kindly. Richard

I was at a friends house and slipped down her stairs (wooden flooring that for sure 3 other people have slipped on). I broke my ankle and tore a ligament resulting in the ligament having to be sewn back and a plate and 10 screws put in to hole the bone. I lost my job and underwent alot of pain and suffering. I was in a wheelchair for 2weeks and on painful crutches for 5 weeks now. Do I have a claim with her homeowners ins and how will she be effected if I do sue and how much is this claim worth????

There is usually medical payments coverage included on a homeowners policy which pays for medical bills regardless of fault.
Whether or not you have a liability claim depends on the laws of an invitee in the jurisdiction where you live.
As far as how much that claim is worth if you have one, that is up to a jury.
